Terms and Conditions of Use
1. Introduction and Acceptance of Terms
Welcome to Servora ("Servora", "we", "us", or "our"). Servora is an Australian-based online platform that connects individuals seeking disability support services ("Consumers") with registered disability service providers ("Service Providers"). Together, Consumers and Service Providers are referred to as "Users" or "you".
By accessing or using the Servora website, mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately cease using the Platform.
These Terms constitute a legally binding agreement between you and Servora Pty Ltd (ABN [insert ABN]), a company registered in Australia. These Terms should be read in conjunction with our Privacy Policy, which is incorporated herein by reference.
2. Eligibility and Account Registration
2.1 Eligibility
To use the Platform, you must:
- Be at least 18 years of age, or have the consent of a parent or legal guardian;
- Be legally capable of entering into a binding contract under Australian law;
- Not be prohibited from using the Platform under any applicable laws or regulations; and
- Provide accurate, current, and complete information during the registration process.
2.2 Account Registration
You must create an account to access most features of the Platform. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account at support@servora.com.au.
Servora reserves the right to refuse registration, suspend, or terminate any account at its sole discretion, including where we reasonably believe information provided is false, misleading, or incomplete.
3. Description of Services
3.1 Platform Role
Servora provides a technology platform that facilitates connections between Consumers and Service Providers. Servora is not itself a disability service provider and does not directly provide any disability support, care, or related services.
3.2 Service Provider Listings
Service Providers may create profiles and listings on the Platform, subject to verification procedures as determined by Servora from time to time. While Servora takes reasonable steps to verify information provided by Service Providers, we do not guarantee the accuracy, completeness, or suitability of any Service Provider profile, qualifications, certifications, or service descriptions.
3.3 Consumer Responsibility
Consumers are solely responsible for assessing the suitability of any Service Provider before engaging their services. Servora strongly encourages Consumers (or their representatives) to conduct their own due diligence, including verifying NDIS registration, qualifications, insurance, Working with Vulnerable People checks, and any other applicable credentials.
4. Location Services and Geolocation Data
4.1 Collection of Location Data
The Platform uses location services to enhance your experience, including helping Consumers discover nearby Service Providers and assisting Service Providers in identifying Consumers within their service areas. By using the Platform, you consent to the collection and processing of your geolocation data.
4.2 Use of Location Data
Your location data is used for the following purposes:
- Displaying geographically relevant Service Provider listings to Consumers;
- Enabling Service Providers to identify and target Consumers in their service regions through advertising features on the Platform;
- Improving the relevance and accuracy of search results and recommendations within the Platform.
4.3 Advertising Use
Location data may be used to facilitate targeted advertising by Service Providers to Consumers within the Platform. This means Service Providers may pay to have their services displayed prominently to Consumers in specific geographic areas. This advertising is conducted within the Servora Platform only and is based on general location parameters.
4.4 Limitations on Use
Servora does not sell, rent, trade, or otherwise transfer your precise location data to third parties outside the Platform for any purpose other than as described in clause 4.3 above. Location data is not used for profiling purposes unrelated to the Platform, nor shared with advertisers outside of the Servora ecosystem.
4.5 Location Permissions
You may disable location services on your device at any time through your device settings. Please note that doing so may limit certain features of the Platform. Where location permissions are disabled, Servora may use other information such as your registered postcode or suburb to provide approximate location-based features.
5. Marketing Communications and Email Consent
5.1 Consent to Receive Marketing Emails
By providing your email address to Servora — whether during account registration, profile setup, or at any other point through the Platform — you expressly consent to receiving marketing and promotional communications from Servora by email. These communications may include:
- Information about new features, updates, and improvements to the Platform;
- Promotions, offers, or service announcements from Servora;
- Curated content relating to disability services, supports, and resources;
- Service Provider spotlight announcements and featured listings.
5.2 Opt-Out Process
You may withdraw your consent to receive marketing emails at any time by sending a written request to support@servora.com.au. Please include your full name, registered email address, and a clear statement that you wish to opt out. Servora will process your opt-out request within 5 business days of receipt.
5.3 Compliance
Servora's marketing communications are conducted in accordance with the Spam Act 2003 (Cth) and the Australian Privacy Act 1988 (Cth).
6. Privacy and Data Protection
Servora is committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Our collection, use, storage, and disclosure of your personal information is governed by our Privacy Policy, available on the Platform. By using the Platform, you acknowledge and consent to the practices described in our Privacy Policy.
In addition to the location data provisions in clause 4, Servora may collect personal information including your name, contact details, date of birth, NDIS plan information (where applicable), device identifiers, and usage data. This information is used to operate and improve the Platform and to facilitate connections between Users.
7. Service Provider Obligations
Service Providers using the Platform represent, warrant, and agree that they:
- Hold all applicable licences, registrations, qualifications, and insurances required to provide their advertised services under Australian law, including NDIS registration where required;
- Will maintain current and accurate profile information at all times;
- Will not misrepresent their qualifications, experience, or the nature of their services;
- Comply with all applicable laws including the National Disability Insurance Scheme Act 2013 (Cth), the Disability Discrimination Act 1992 (Cth), and relevant state and territory legislation;
- Are solely responsible for the services they provide to Consumers and for any outcomes arising from those services;
- Will hold adequate professional indemnity and public liability insurance; and
- Consent to Servora using their location data for the purposes of geographic advertising and matching as described in clause 4.
8. Consumer Obligations
Consumers using the Platform represent, warrant, and agree that they:
- Will provide accurate information when creating an account and when seeking services;
- Are solely responsible for their selection of a Service Provider and for any agreements entered into with Service Providers;
- Understand that Servora does not guarantee the quality, safety, suitability, or legality of services provided by any Service Provider;
- Will treat Service Providers with dignity and respect; and
- Will report any concerns regarding a Service Provider's conduct to Servora at support@servora.com.au.
9. Prohibited Conduct
Users must not use the Platform to:
- Post false, misleading, or deceptive information;
- Harass, threaten, or discriminate against any other User;
- Violate any applicable law or regulation;
- Engage in any conduct that could harm, disrupt, or interfere with the Platform or its infrastructure;
- Attempt to gain unauthorised access to any part of the Platform;
- Reproduce, distribute, or commercially exploit any content from the Platform without prior written consent from Servora; or
- Use the Platform for any purpose other than its intended function of connecting Consumers with Service Providers.
10. Fees, Subscriptions, and Payment
10.1 Subscription Fee
Access to the Platform for Service Providers requires a paid subscription ("Subscription Fee"). Servora currently offers the following plans:
- Monthly plan — AUD $12.00 per month (exclusive of GST), being AUD $13.20 per month inclusive of GST, charged on a recurring monthly basis;
- Annual plan — AUD $100.00 per year (exclusive of GST), being AUD $110.00 per year inclusive of GST, charged once per year.
The Subscription Fee is charged commencing on the date you activate your subscription and recurs automatically for the plan you select. By subscribing to the Platform, you authorise Servora (through its payment processor) to charge the Subscription Fee to your nominated payment method each billing period on or around the same date as your initial subscription date, until your subscription is cancelled in accordance with clause 10.4.
10.1A Promotional Discounts
Servora may from time to time offer promotional or foundation-member discount codes that reduce the Subscription Fee for an introductory period. Discounts apply only to the plan and billing period for which the code is valid, cannot be combined unless expressly stated, and the standard Subscription Fee applies once the promotional period ends.
10.2 Payment Processing via Stripe
All payments on the Platform are processed by Stripe Payments Australia Pty Ltd ("Stripe"), a third-party payment processor. Servora does not store your full payment card details or bank account numbers directly; these are held and managed by Stripe in accordance with PCI-DSS standards. Servora is not liable for any errors, failures, or delays arising from Stripe's payment processing services.
10.3 GST
All fees displayed on the Platform are exclusive of GST unless expressly stated otherwise. GST is applicable at the current rate of 10% and is added to all applicable fees at checkout. Servora will issue a valid tax invoice for all charges where required under the A New Tax System (Goods and Services Tax) Act 1999 (Cth).
10.4 Subscription Cancellation and Refunds
You may cancel your subscription at any time by contacting support@servora.com.au. Cancellation will take effect at the end of the current billing period; no partial-month refunds will be issued. Servora reserves the right to amend the Subscription Fee at any time with at least 30 days' written notice.
10.5 Event Posting Fee
Service Providers who wish to publish an event on the Platform will incur a one-time flat fee of AUD $1.00 (exclusive of GST) per event published, being AUD $1.10 inclusive of GST ("Event Posting Fee"). Event posting credits are purchased through the Platform, are charged at the time of purchase, and are non-refundable once the event post has been published on the Platform.
10.6 Disclaimer Regarding Event Content
Servora does not verify, validate, or endorse the accuracy, completeness, legality, or legitimacy of any information contained within an event posting. Users access event listings and engage with event organisers entirely at their own risk. Servora accepts no liability for any loss, damage, injury, or harm arising from attendance at or reliance upon any event listed on the Platform.
10.7 Service Provider Fees to Consumers
Service Providers are solely responsible for any fees, charges, or agreements made directly with Consumers for the provision of disability support services. Servora is not a party to any such agreement and accepts no liability in relation thereto.
11. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of Servora or its content suppliers and is protected by Australian and international intellectual property laws. Users are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for its intended purposes only.
Users retain ownership of content they submit to the Platform but grant Servora a worldwide, royalty-free, non-exclusive licence to use, reproduce, and display such content for the purposes of operating the Platform.
12. Disclaimers and Limitation of Liability
12.1 Platform Provided "As Is"
The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable Australian law, Servora disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
12.2 No Liability for Service Provider Conduct
Servora is not liable for any act, omission, negligence, misconduct, or breach of obligation by any Service Provider. Users engage with Service Providers entirely at their own risk.
12.3 Limitation
To the maximum extent permitted by law, Servora's total liability to any User for any claim arising from or related to the Platform shall not exceed the total fees paid by that User to Servora in the three (3) months preceding the claim. Nothing in these Terms excludes any rights or guarantees that cannot be excluded under the Australian Consumer Law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Servora and its officers, directors, employees, and agents from and against any claims, losses, liabilities, damages, costs, and expenses (including legal fees on a solicitor-client basis) arising from: (a) your use of the Platform; (b) your breach of these Terms; (c) content you submit to the Platform; or (d) your interactions with any other User.
14. Termination
Servora reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe you have breached these Terms or if we are required to do so by law. You may close your account at any time by contacting support@servora.com.au. Termination of your account does not affect the validity of any clause of these Terms intended to survive termination.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. You agree to submit to the exclusive jurisdiction of the courts of Western Australia for the resolution of any dispute arising from or related to these Terms or your use of the Platform.
Before commencing legal proceedings, both parties agree to attempt to resolve any dispute through good faith negotiation. If resolution cannot be achieved within 30 days of written notice of a dispute, either party may refer the matter to mediation through the Resolution Institute or a mutually agreed mediator.
16. Changes to These Terms
Servora may update these Terms from time to time. Where changes are material, we will provide reasonable notice via email or through a notice on the Platform. Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of those changes.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Servora with respect to your use of the Platform.
17.2 Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver
Failure by Servora to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without Servora's prior written consent. Servora may assign these Terms freely.
17.5 Relationship of Parties
Nothing in these Terms creates a partnership, employment, agency, or joint venture relationship between you and Servora.
